Terms of Service
यह पेज अभी हिंदी में नहीं है, इसलिए अंग्रेज़ी में दिखाया गया है।
These terms are a contract between you and WIA ("WIA", "we"). By creating an account or using WIA you agree to them. If you don't agree, don't use WIA.
1. Who can use WIA
You must be at least 18 and able to form a binding contract under Indian law. One person, one account. You must give true details and keep your login private. You are responsible for everything done from your account.
2. What WIA is
WIA is a platform where people in Jodhpur share posts, stories and messages, and may join plans and city updates. We are an intermediary under the Information Technology Act, 2000. We don't create, check or endorse what members post, and we don't vet members, hosts or meetups.
3. Your content
You own what you post. You give WIA a worldwide, non-exclusive, royalty-free, transferable and sub-licensable licence to host, store, copy, display, adapt (for format and size), translate and distribute it to run, show and promote WIA. The licence ends when you delete the content, except for copies others have already shared, backups kept for a limited time, and copies we must keep by law. You confirm you have the rights to everything you post and that people shown in it agreed.
4. What you must not do
You must not post or do anything that breaks our Community Guidelines or Indian law. That includes content that is obscene, sexual involving anyone under 18, defamatory, harassing, hateful, threatening, misleading, infringing, or that impersonates someone. You must not spam, scrape, use bots, sell accounts, collect other people's data, get around a block or suspension, or try to break or overload our systems.
5. Our rights to moderate
We may review, limit, label, hide or remove any content, and warn, restrict, suspend or ban any account, at our discretion. We do this when we believe it breaks these terms, the Guidelines or the law, or puts people or WIA at risk. We will tell you the rule involved, and you can appeal once through the app. We don't have to keep or restore removed content, except where the law says so.
6. Plans, meetups and meeting people
Plans are organised by members, not by WIA. You attend at your own risk and decide for yourself whether to meet someone. WIA isn't responsible for the conduct of any member, host or attendee, or for anything that happens at a meetup, including loss, injury or damage, except where it is caused by our own proven negligence. Follow our Safety page. Report anything unsafe right away, and call 112 in an emergency.
7. City Pulse and information
Updates are posted by members and expire. We don't check them. Don't rely on them for safety, travel, health or financial decisions.
8. Changes and availability
We may change, pause or end any feature, limit or part of WIA at any time. We may also update these terms: we'll show the new date here and tell you in the app when a change is important. If you keep using WIA after a change, you accept it.
9. No warranties
WIA is provided "as is" and "as available". To the fullest extent the law allows, we give no warranty that it will be uninterrupted, error-free, secure or fit for a particular purpose.
10. Limit of liability
To the fullest extent the law allows, WIA and its team and partners are not liable for indirect, incidental, special or consequential loss, lost data, profits or reputation, or anything caused by other members. Our total liability to you for any claim is capped at ₹1,000 or the fees you paid us in the 12 months before the claim, whichever is higher. Nothing here limits liability for fraud, or anything else the law doesn't let us limit.
11. Indemnity
You will compensate WIA for any claim, loss, fine or cost (including reasonable legal fees) caused by your content, your conduct, your meetups, or your breach of these terms or the law.
12. Ending your account
You can delete your account at any time in Settings; deletion is final after 30 days (see Data Deletion). We may end or suspend your access as in section 5. Sections 3 (copies already shared), 6, 9, 10, 11 and 13 continue after your account ends.
13. Law and disputes
These terms are governed by the laws of India. First write to grievance@getwia.com so we can try to solve it. Any dispute not solved in 30 days goes to arbitration by a sole arbitrator appointed by mutual agreement (or, failing that, as the law provides) under the Arbitration and Conciliation Act, 1996, seated in Jodhpur, in English. Subject to that, the courts at Jodhpur, Rajasthan have exclusive jurisdiction. This doesn't remove any right you have before a consumer commission.
14. General
If one part of these terms can't be enforced, the rest still applies. If we don't enforce a right, we haven't given it up. You can't transfer these terms; we can, for example to a new owner of WIA. Questions: support@getwia.com.
